Based on OKVED data, information about the activities of a new company or individual entrepreneur is entered into the unified state register legal entities(Unified State Register of Legal Entities) or in the unified state register individual entrepreneurs(USRIP). Moreover, if when creating an individual entrepreneur they will be indicated only in the application, then when creating an LLC it is necessary to reflect them in the charter of the organization being created.

In addition, the tax authority sends information about the types of activities to the Social Insurance Fund, which registers policyholders and sets the amount of the insurance tariff, that is, the contribution for compulsory social insurance of workers against industrial accidents and occupational diseases. At the same time, the company must annually confirm its tariff, otherwise its size will be set automatically in maximum size. Despite the fact that, in accordance with Russian legislation, a company can carry out any types of activities not prohibited by law, including those not specified during registration (except for types of activities subject to licensing), it is still better to reflect the real state of affairs in the documents. In addition, OKVED codes are required when registering with the Compulsory Medical Insurance Fund, the Pension Fund, as well as in some banks to open a current account.

OKVED structure

Species grouping code economic activity consists of two to six digital characters, and its structure can be represented as follows:

How to choose the right type of activity according to OKVED?

When choosing a code, you need to move from general to specific. First, a field of activity is selected (for example, fishing, financial activities, etc.), then a section is determined. Then the searches are carried out in this section: subsection, class, subclass, group, subgroup, and finally, you need to determine specific type economic activity of the necessary organization.

The first selected OKVED code is decisive for the company and must necessarily correspond to its main type of economic activity. There are almost no restrictions on the number of types of activities; you can enter even the entire classifier. However, at least one code must still be indicated in the documents. Typically, companies are limited to five or six types of activities; it is not recommended to indicate more than twenty.

Current legislation requires a code consisting of at least three digits. If you do not want to indicate exactly the type of economic activity (for example, if you want to give the company more freedom to operate within the selected section), you can specify only the subclass of the section. But it is still advisable to choose economic activity codes containing at least four digits.

Choose the right type activities according to OKVED are not always simple. If any difficulties arise, you can refer to Appendix A of the classifier, which contains detailed description all types of activities, including types falling under the category of other types of activities.

OKVED registration

After selecting OKVED codes, you must contact the registration authority at your place of residence to submit an application, which will contain the selected codes. Registration of OKVED will be carried out together with the registration of the company. If you later need to change or add the new kind activity, a new OKVED code should be added. To do this, it is necessary to prepare a corresponding application and send it to the body that carried out the registration earlier. Incorrect registered codes can be corrected. However, corrections will inevitably entail wasted time and money (payment of a fee for registering changes to the charter or information in the Unified State Register of Legal Entities/Unified State Register of Legal Entities), so it is advisable to select the correct codes right away.

“Selecting codes in the classifier can become a very painstaking task,” comments Olga Antonovskaya, chief accountant of Asgard CJSC. “So instead of reading a huge classifier from cover to cover, you can consult with entrepreneurs who are already working in the chosen areas. This will significantly reduce the time it takes to find the required codes. However, such codes are definitely worth checking; you need to check several times even those codes that you personally chose. The fact is that the tax office cannot independently make adjustments to the application, therefore, if there is an error, it is considered as reporting incorrect information, which automatically entails refusal of registration. Challenging such refusals in court is a long-term, exhausting matter and usually ends not in favor of entrepreneurs. You should be very careful when choosing an OKVED code for activities that require a license. It is highly advisable to find out exactly what it is from the relevant authority, so as not to become a victim of a license denial due to an incorrectly chosen code. In general, if you approach the process consciously, it is not difficult to understand OKVED. As a last resort, you can entrust this to professionals: the service is very inexpensive, and you won’t have to waste time and nerves at all.”

The OKVED code is assigned to all enterprises that operate in Russia and needs to be updated annually by the statistical authorities.

What is OKVED: why is it needed?

The OKVED code determines which line of activity this enterprise belongs to. This is necessary to register an enterprise or obtain the status of an individual entrepreneur.

The code of the type of economic activity is determined by the legal or an individual independently, but approved by the statistics body.

Based on this classifier, the statistics body keeps records and analyzes the functioning of enterprises in the context of economic activity. The OKVED code is used when registering bank details, in particular, OKPO.

The code is also used when preparing documents and accrediting a company in customs authorities. The presence of a code allows a legal entity to take part in tenders, licensing and audits regulatory authorities.

OKVED classifier: coding structure

The classifier consists of 17 sections. OKVED does not take into account the division of enterprises by form of ownership, organizational and legal form, or departmental subordination.

The code does not distinguish between foreign and domestic trade, commercial and non-commercial activities, foreign and domestic trade.

The classification of activities has a hierarchical subordination. The encoding uses 2-6 characters, but when state registration of an enterprise, at least four digital characters must be indicated.

Let us denote each digital character by zero, then the structure of the classifier has the form:

  • 00. – class;
  • 00.0 – subclass;
  • 00.00 – group;
  • 00.00.0 – subgroup;
  • 00.00.00 – view.

The more numbers in the code, the more detailed the activities of the enterprise are deciphered. It is not always advisable to use detailed decoding.

If a company, for example, produces paper products for household needs and indicated coding 21.22, then when expanding production and introducing other types of paper products, the company will need additional registration of this type of activity.

To avoid re-registration, you can specify several directions in the code that may be used in the future.

Based on OKVED codes, a classification of levels of industrial injuries and occupational morbidity (32 classes) has been created. This classification allows us to obtain social payments in the event of accidents at work, and the company must pay contributions in accordance with social insurance tariffs.

The higher the hazard class, the higher the tariff denomination. OKVED data is confirmed annually by financial statements.

If the enterprise refused to confirm or did not confirm the type of activity according to the classifier in time, then the Social Insurance Fund body will perform the coding independently. In this case, the maximum professional risk will be selected according to this species activity according to the classifier, accordingly, social insurance contributions will be higher.

How to choose types of OKVED?

OKVED coding does not imply any liability on the part of the registered entity entrepreneurial activity, including does not contain rights and obligations for legal entities and individuals.

As of July 4, 2013, changes to the preparation of documents for registration came into force. According to the new requirements, the OKVED code must contain at least 4 digital characters (Order of the Federal Tax Service of Russia dated January 25, 2012 No. MM V-7-6/25@).

To register, it is enough to indicate one type of activity. The maximum number of directions is unlimited, but it is not recommended to register more than 30 positions. The decoding of each code is not indicated in the statement under the new standard.

If the OKVED code is lost, you can restore it using the classifier, and then confirm it before submitting reports to the statistics agency at the beginning of the year.

When it is not possible to restore the encoding on your own, Rosstat will issue the information again for a fee at the request of the entrepreneur.

To decipher OKVED, you need to find the section of the classifier by the first digits of the code up to the point, then directly in the section find the desired item of the type of activity according to the digits of the code.

It should be remembered that when changing the type of activity, a legal entity must also make changes to the Unified State Register of Legal Entities (Unified State Register of Legal Entities).

Private (individual) entrepreneurs make changes to the Unified State Register of Individual Entrepreneurs (USRIP). To do this, within three days, the amended data is submitted in the prescribed form to the territorial body of the Federal Tax Service of the Russian Federation.

Classifier OKVED-2

The OKVED classifier or reference book is a special document developed by Rosstandart. Until 2017, three editions of the classifier were in effect at once, which sometimes led to errors in the selection of OKVED codes and refusal of state registration of individual entrepreneurs. Since mid-2016, the OKVED-2 or OK 029-2014 (NACE Rev. 2) classifier, approved by Rosstandart Order dated January 31, 2014 N 14-Art., has been used to register individual entrepreneurs and legal entities.

Use only the current edition of the classifier from reliable sources! If you indicate the type of activity according to OKVED from the invalid edition of OKVED, you will receive a refusal to register an individual entrepreneur.

OKVED-2 consists of 21 sections, having letter designation Latin alphabet. Each section is divided into class, subclass, group, subgroup and species. In an application for registration of an individual entrepreneur, the digital code according to OKVED must be four, five or six digits. Let's look at an example of how to choose an individual entrepreneur type of activity.

Let's say a future entrepreneur wants to set up a stall to produce and sell fast food. In the classifier, this line of business has group code 56.10 and the characteristic “Restaurant activities and food delivery services.”

The group with the OKVED code 56.10 includes a subgroup with the code 56.10.2 (Activities for the preparation and/or sale of food ready for immediate consumption on the spot, from vehicles or mobile benches), and it, in turn, includes a code of the type 56.10 .24 “Activities of market stalls and food preparation stalls.”

If you indicate in the application the OKVED code for individual entrepreneurs of four characters (56.10), then you will be able to engage in other types of activities included in this group:

  • 56.10.1: Activities of restaurants and cafes with full restaurant service, cafeterias, fast food and self-service restaurants
  • 56.10.3: Activities of restaurants and bars to provide food in railway dining cars and on ships.

If you enter in the application P21001 only the type of activity with code 56.10.24, you will not be able to open it summer cafe or a restaurant until you report the new code to the tax office. Excessive detail is not needed here, so we recommend indicating the type of activity of the individual entrepreneur in the format of a four-digit code.

Please note that some areas of business are not available to an individual entrepreneur. For example, in order to sell strong alcohol, open a pawnshop, engage in microfinance or insurance activities, you must register commercial organization(LLC or JSC).

How many OKVED codes can you choose?

When registering an individual entrepreneur, the types of activities that are included in application P21001 are not limited. Sheet “A” holds 57 codes, but if this is not enough for you, then you can fill out the second and third sheet “A”. Typically, applicants indicate 10-20 codes to describe related areas of business.

The mere indication of multiple codes when registering an individual entrepreneur does not affect anything. In reality, there is no need to carry out all the chosen directions, submit separate reports or pay more taxes. But there’s also no point in trying to enter as many OKVED codes as possible, just in case. Later, an individual entrepreneur can always add types of activities by submitting a special form P24001.

One of the OKVED codes, according to which the maximum income is expected to be received, must be selected as the main one. The main code is important when choosing a tariff for employee injury insurance. The higher the risk of injury at work or occupational disease, the higher the rate of contributions established by law.

Certain types of activities must be licensed, i.e. obtain mandatory permission to engage in them. If a licensed type of activity is in the codes you have chosen, this does not mean that you need to immediately issue a license. It will only be needed when you actually start this business.

How to choose an OKVED code

When ordering an individual entrepreneur registration service, professional registrars will select codes for you. But if you are willing to spend a little time and effort, then it is not at all necessary to contact a lawyer.

Application P21001 is a simple document to fill out; you only need to indicate the passport details of the future entrepreneur and the direction of business. The OKVED classifier is freely available in legal reference systems, free services for preparing registration documents, and other sources. The main thing is to pay attention to the fact that the OKVED directory you found was approved by order of Rosstandart dated January 31, 2014 N 14-Art.

As follows from Article 5 of Federal Law No. 125-FZ dated July 24, 1998, persons (including foreigners and stateless persons) performing work on the basis of:

  • employment contract;
  • a civil contract, if under such a contract the policyholder is obliged to pay insurance premiums for them.

From payments and other remuneration in favor of the insured persons, the policyholder is obliged to pay insurance premiums in case of injury (Clause 1, Article 20.1 of Law No. 125-FZ).

The amount of contributions depends on the insurance tariff (Clause 1, Article 22 of Law No. 125-FZ), and the insurance tariff depends on the class of professional risk, which the territorial body of the Federal Insurance Service of the Russian Federation establishes in accordance with the main type of activity of the policyholder.

Professional risk classes and insurance rates

Types of economic activities are classified and coded in accordance with OKVED, approved by Decree of the State Standard of Russia dated November 6, 2001 No. 454-st.

The procedure for classifying types of economic activity as occupational risk is determined by the Rules approved by Decree of the Government of the Russian Federation dated December 1, 2005 No. 713 (hereinafter referred to as the Rules). The classification of activities by risk classes was approved by Order of the Ministry of Labor of Russia dated December 25, 2012 No. 625n.

Insurance rates, differentiated by 32 classes of professional risk, are established annually by federal law (Part 1, Article 21 of Law No. 125-FZ). According to Article 1 of the Federal Law dated December 2, 2013 No. 323-FZ, in 2014 insurance premiums for injuries are paid in the manner and at the rates established by the Federal Law dated December 22, 2005 No. 179-FZ. Example. One of the economic activities of the OLIMPstroy organization is the construction of sports facilities. According to OKVED, the type of activity “construction of sports facilities” is assigned OKVED code 45.23.2. This type of activity belongs to class VIII professional risk. For this class, the insurance rate is 0.9%. From payments in favor of the insured persons, the policyholder will pay insurance premiums in case of injury in the amount of 0.9% of these amounts.

How to determine the main activity

The main type of economic activity of the company is the one that, based on the results of the previous year, has the largest specific gravity in the total volume of products produced and services provided (clause 9 of the Rules). In practice, to determine the main type of activity, the indicator of the share of revenue from sales of products for the compared types of activities is used.

Example. The first type of activity of the OLIMPstroy company is the construction of sports facilities (code 45.23.2 OKVED). The second type of activity is preparation of the construction site (code 45.1 OKVED).

The total revenue for 2013 amounted to 100 million rubles. (excluding VAT), of which the amount of revenue:

  • for the first type of activity - 75 million rubles. (without VAT);
  • for the second - 25 million rubles. (without VAT).

Let's calculate the share of income for each type of activity of the organization. To do this, divide the revenue for each type of activity by the total revenue and multiply by 100%.

The share of income for the first type of activity of the organization will be equal to 75% (75 million rubles: 100 million rubles × 100%).

For the second type of activity, the share of income will be 25% (25 million rubles: 100 million rubles × 100%).

Since the share of income from the first type of activity is greater, it will be the main one for the organization.

As a result of calculations, it may turn out that the total amount of revenue was made up of equal parts of revenue for different types activities of the organization. In this case, the FSS of the Russian Federation recognizes as the main type of economic activity the one that has the highest class of professional risk (clause 14 of the Rules).

Example. The first type of activity of the OLIMPstroy organization is the construction of sports facilities (code 45.23.2 OKVED). The second type of activity is preparation of the construction site (code 45.1 OKVED). Both types of economic activities are distributed in equal parts in the total volume of products produced and services provided. The first type of activity of the organization belongs to class VIII of professional risk (corresponding to a tariff of 0.9%), the second - to class XI (tariff of 1.2%). Consequently, the main type of economic activity of the organization will be the second - preparation of the construction site (code 45.1 OKVED). The FSS of the Russian Federation will establish occupational risk class XI for OLIMPstroy.

Beginning businessmen are often faced with the need to obtain OKVED, but not everyone knows what it is, what it is for, and how it is correctly deciphered. These and numerous other questions will be discussed in the next article.

What is OKVED?

The answer to this question lies in the decoding of the abbreviation OKVED - this is an all-Russian classifier of the type of economic activity. Do OKVED codes affect anything?

It has already been noted why it is necessary to obtain codes. But does the core activity code affect the range of services and, if so, how? Let's look at some of the nuances of this issue:

  1. The OKVED code does not limit your work. That is, if a company takes an order that does not 100% correspond to its profile, then this is not considered an error or violation. However, if similar situation is repeated systematically, then you will have to either change OKVED or bear responsibility in accordance with the law.
  2. The main activity of the company is usually the one that generates the most income. If a company consistently earns more income from additional activities, then the codes will have to be changed.
  3. If the director of an organization decides to change his profile (and, accordingly, change OKVED), then he will have to gather the company’s management council in order to obtain official approval for this change.

Where can I get OKVED?

Finding out your OKVED code is not difficult - to do this, just refer to the relevant classifications presented on many sites on the Internet and choose the one that suits you best. Of course, to start your own business self-selection It’s not enough - you need to officially receive the code. There are several options here:

  • Registration tax authority. In some cases, a tax organization can help with obtaining an OKVED code. You need to contact her when submitting documents for business registration: service employees will not refuse to help you obtain the code, although this is not their main responsibility.
  • Self-receipt. If you were unable to obtain the code from the tax authority, then you need to contact the nearest State Statistics Service office. Before visiting, you need to collect a package of documents, which differ for LLCs. For individual entrepreneurs, you will need copies of the following documents: passport, TIN, extract from the Unified State Register of Individual Entrepreneurs and registration certificate.
    For an organization, the list of copies is slightly different: certificate of state registration of legal entities, TIN, charter, passport of the company director, charter and power of attorney, if necessary.

  • Service of the official website of the State Statistics Service. Allows you to receive your code online in the shortest possible time. To receive an individual code, you will need to indicate the region in which the LLC or individual entrepreneur was registered, as well as the TIN. The service has been operating relatively recently, so there is not much information contained on it: you risk simply not finding the region you are interested in.
  • Receipt through third parties. Many organizations that help businessmen register a business are also willing to help with obtaining OKVED codes. This service is also provided separately: its cost will not exceed 2,000 rubles.

When you first receive an OKVED code from the State Statistics Service, you do not pay state fees, but if the document is suddenly lost, you will have to pay for re-issuance. To avoid troubles with restoring the code, it is recommended to make 1-2 photocopies of it.

What to do if OKVED changes?

Primary activity codes can be changed completely free of charge, without paying any fees or contributions. The procedure is complicated in that it requires a lot of paperwork: to change the code, you need to refill a number of documents in the P14001 form, namely:

  • 1 page. Here in paragraph 2 you will need to indicate the number 1 (since we are changing information about the legal entity), and also make the required changes to paragraphs 1.1, 1.2, 1.3, 2.
  • Page 1 sheet N. In paragraph 1.1 we write a new code.
  • Page 2 sheet N. Old code, which we are changing is indicated in paragraph 2.1, it must exactly match the code contained in . There is no need to fill out any more information on sheets H, and there is no need to change any codes there.
  • Pages 1 to 4 in sheets R. Filled out in accordance with the new forms of registration of legal entities indicating the new codes.

When filling out applications, code numbers must be written from left to right, indicating each number in a new separate cell.

Filling begins from the first cell. The completed application must consist of 7 sheets. With it, as well as other details, the company will need to come to the notary, and then to the Federal Tax Service. A similar form will also be filled out when an additional code is entered (if the company has two or more activity profiles), when it is changed, or deleted. You can carry out the procedure for changing or deleting codes yourself or through special organizations offering services for such work, where professionals will competently fill out the documentation and help you quickly change or delete the profile of interest.

OKVED for online stores

If you decide to open an online store, then keep in mind that it operates under the same conditions as a physical store: it pays taxes, is listed as a separate organization, and has employees. That is why you will also need to obtain a special code to register it. Here are some tips to give:

  • If the store has opened recently and exists exclusively in the virtual space, then it will be necessary to indicate the code corresponding to retail trade.
  • In situations where an online store provides direct delivery to the buyer, you will need to specify a code corresponding to the parcel trade.
