Legislation in the field of labor protection establishes that the employer must provide its employees with special protective clothing and means, as well as arrange for the provision of employees with flushing and (or) neutralizing agents.

The provision of PPE for employees is regulated by several documents at once:

  • intersectoral rules for providing employees with PPE, approved by order of the Ministry of Health and Social Development dated June 1, 2009 No. 290n - they establish general rules, which should guide the employer when issuing PPE;
  • standard norms for the free issue of overalls are not one document. Each sector of the economy and types of work has its own rules. The employer buys all protective equipment, substances and clothing at his own expense, he has the right to deduct these amounts from employees only in one case, when the employee, upon dismissal, does not hand over overalls, the service life of which has expired. The amount is not retained in full, but in proportion to depreciation. If the worker handed over the clothes, then it is forbidden to deduct its value.

The employer has the right not to acquire, but to rent protective equipment.

Providing workers with personal protective equipment

In addition to the above regulations, the issuance of workwear at the enterprise will be regulated by special assessment cards for working conditions. This is especially true in cases where the full-time position differs from those given in the standard norms, and the work performed involves the issuance of PPE.

Issuance of overalls to employees

Personal protective equipment is issued to employees who are required to have it. Otherwise, it will be a violation of labor laws.

Workwear issued to employees includes:

  • special suits and jackets that protect workers from the effects of negative factors. They can be simply cotton or with a special coating;
  • safety shoes;
  • protective mittens and gloves.

All of them must have a certificate of conformity provided by the supplier. Please note that the certificate has an expiration date and it is impossible to purchase clothes whose certification period has expired.

Personal protective equipment includes:

  • respiratory protection (respirators, masks, etc.);
  • protective glasses;
  • protective helmets;
  • protective belts, fastenings and ladders;
  • others protective devices(dielectric mats, dielectric gloves, etc.)

All protective equipment must also be certified. The shelf life of funds, most often, is expressed not in terms of time, but out of service.

Some protective equipment must be verified, for example, dielectric devices (mats, gloves) and means for working at height (fastenings, stepladders).

Issuance of washing and neutralizing agents

The issuance of soap and disinfectants is determined not by the title of the position, but by the type of work and the substances that are used.

Washing and protective substances include:

  • protective agents (creams and emulsions that protect the skin);
  • washing agents (soap, special substances for washing water-insoluble substances);
  • disinfectants (sprays, aerosols and antibacterial liquids).

All products must also be certified, including solid soap.

The issuance of overalls to employees must be documented.

In this case, two types of documents are drawn up:

  1. a document that reflects the movement of overalls at the enterprise (forms MB-2, MB-4, MB-7, MB-8);
  2. a document that reflects the provision of the necessary set of overalls for a particular employee (personal PPE record card).

The first document is used for the needs of accounting, most often they use the MB-7 form (at the link you will find an example of filling out and a form form), it contains a list of workers who received overalls, its name and characteristics. Personal PPE accounting card is a mandatory document. Rules for providing workers with personal protective equipment

Standard norms for the issuance of protective equipment by profession are contained in the Order of the Ministry of Health and Social Development of the Russian Federation dated 03.10.2008 No. 543n and other industry regulations. Responsibilities of the employer in terms of providing personal protective equipment

When purchasing personal protective equipment, the employer is obliged to check whether their mandatory certification has been carried out, whether they have passed tests, declarations, in accordance with all the rules, in accordance with the Federal Law “On Technical Regulation”. If such measures have not been taken, then there are two ways - to refuse such a batch of PPE or to conduct testing and certification on your own. Many choose the first option, but if the cost of the second option is significantly lower, then there are those who decide to carry out independent work. But there is a serious risk here, because it is not known whether the commission recognizes these PPE as fit for use.

The employer is obliged to organize a strict accounting of the issuance of personal protective equipment to its employees, in compliance with the deadlines of the schedule. The handover of those who have served is also carefully organized. special means. All property movements are recorded in cards that are filled out according to certain form, which can be found in the Appendix to the Rules, which we have already mentioned. The only indulgence that the law makes is that keeping cards is allowed in electronic form.

The employer is obliged to conduct regular briefings on the use of PPE for both new employees and permanent employees who have worked for a certain period. Briefings are also held for those who are hired temporarily or under a contract, whose activities are related to the use of personal protective equipment. At such briefings, employees are taught how to wear certain protective items, how to quickly put them on in critical cases, how to check the serviceability, what to do if the integrity of the protective equipment is violated or it becomes unusable.

And another important area in this work is the conduct of trainings on the use and use of personal protective equipment, that is, the practical development of skills. It is clear that it is not necessary to work out a dressing gown, but a respirator, a mask, glasses, galoshes, etc., are somewhat of a mystery to some, which is very surprising. Sometimes I had to observe rather absurd situations at such trainings. Someone took off their shoes to put on dielectric galoshes, someone took off their glasses with diopters to put on goggles and start working. Therefore, trainings are needed, and they have to explain the most elementary things. In addition to all of the above, the employer is obliged to issue, change and repair at his own expense the failed protective equipment even before the end of the planned operation. If PPE is lost due to reasons beyond the control of employees, then the employer is obliged to issue new ones (now it’s clear why video cameras are being installed?). Also, the owner of the enterprise is obliged to conduct tests, check the serviceability of protective equipment, after which a stamp is affixed, branded, with the date of work.

Care, storage, dry cleaning, degassing, washing, disinfection, decontamination, drying, dusting of personal protective equipment lies with the employer, that is, everything must be done by his forces and at his expense. For the smooth implementation of these measures, employees are issued a spare set of personal protective equipment immediately, and the period of their use in the documents is doubled. To carry out these activities, specialized companies are involved, which have all the resources to quality care for PPE.

In addition to everything listed above, employers are required to provide employees with wardrobe rooms where there are specially equipped places for storing protective equipment in accordance with all the rules. He is also obliged to ensure that all work at the enterprise is carried out using personal protective equipment if the employee violates this requirement, then he should be suspended from work with subsequent punishment. The same thing happens when using faulty PPE, contaminated, expired.

The employee, seeing these violations, must also take measures to preserve his health, that is, refuse to perform work, stating in writing the reason for the refusal. If such a fact is revealed, then the employer is obliged to eliminate the shortcomings and issue the employee with a new set of personal protective equipment, and only then require the performance of work.
