The government published on the official website the terms of the renewed program of assistance to mortgage borrowers in difficult financial circumstances. As follows from the government decree, the updated program allowing citizens to receive assistance from the state will be stricter than the previous one. The key change is that although the updated program formally applies to both ruble and foreign currency loans, in fact only foreign currency mortgage borrowers and people who have a loan in rubles, but with a variable rate, are eligible for it.

The total volume of the updated program is 2 billion rubles, the document says. Its extension will make it possible to restructure at least 1.3 thousand mortgage loans, as indicated on the government website. As part of the updated program, banks will restructure a problem foreign currency mortgage at a ruble rate for a client not exceeding 11.5% or a ruble problem mortgage at a rate not higher than the rate in effect on the date of loan restructuring.

The program itself comes into force seven days after the publication of official legal information on the website, that is, on August 22, explained Alexey Nidens, managing director of the Agency for Housing Mortgage Lending (AHML, program operator). “But borrowers can seek advice and submit an application to banks for participation in the program now - the procedure for working under the program is already well known to most credit institutions,” says Niedens. From August 22, banks participating in the state support program will be able to send their borrowers’ applications for consideration to AHML, explained Tatyana Ushkova, Deputy Chairman of the Board of Absolut Bank. The end date of the program is not established in the document - it will end as the funds provided by AHML are exhausted.

As AHML clarified, 97 banks that previously collaborated with AHML under the previous version of the program will participate in the program. RBC surveyed large mortgage banks, but in the evening only Sberbank, Absolut Bank and Sovcombank were able to promptly give a positive answer about participation in the updated program. The rest of the mortgage market participants surveyed did not have time to respond to RBC's request.

The state program to support mortgage borrowers was launched in April 2015 and was valid until May 2017. The government allocated 4.5 billion rubles for the first version of the program. In fact, the program ended ahead of schedule - banks chose the provided limit in March 2017.

Initially, the program provided for the restructuring of ruble and foreign currency mortgage loans at a rate not exceeding 12% per annum and compensation of part of the monthly payment (but not more than 1.5 million rubles in total). Since December 2016, for a family with one or two children, the maximum amount of assistance was 20%, but not more than 600 thousand rubles. For all other categories of citizens listed in the resolution (including citizens with disabilities, veterans) - 30% and 1.5 million rubles.

According to the banks participating in the program, during the period of its implementation, over 50 thousand applications from citizens for the restructuring of mortgage housing loans were received. Of these, assistance was approved for 19 thousand borrowers. As the Kommersant newspaper wrote, 16 thousand applications at the end of the program met the requirements, but were not restructured due to the depletion of the AHML fund. Now these borrowers will have to apply for help again, as stated in the new government decree.

What's new in the terms of the program?

The main difference between the new program and the old one, which is precisely what cuts off problem ruble borrowers, is framed as a new condition for participation in the program for borrowers, which did not exist before. “We must understand that the first wave of the program to support mortgage holders in difficult situations was more focused on holders of ruble loans - only a small share of the previously allocated 4.5 billion rubles. fell on foreign currency mortgage holders,” says Vyacheslav Putilovsky, junior director for banking ratings at Expert RA. “But the problem of foreign currency mortgagers remains, and, apparently, the government decided to make such a cutoff for ruble mortgagers in order to at least partially solve the problems of the former. Previously, the approach would have been different. According to Elena Kovyrzina, director of the retail business lending department at Absolut Bank, during the last program at their bank, the bulk of the restructuring fell on clients with ruble mortgages - these turned out to be 65% of the total number who received support. The new resolution clarifies that you can apply for participation in the program only if the “life” of the loan has already exceeded one year.

The collateral housing, as previously provided, must be the only home of the borrower’s family starting from April 30, 2015 before the date the borrower submits an application for participation. But AHML will now independently check data from the Unified State Register of Real Estate, Nidens adds. The real estate that is secured by such a mortgage loan must meet the following conditions: residential buildings must be purchased specifically with a mortgage. The conditions that the issued mortgage loan must meet are determined:

    • the purpose of the issued loan is shared construction, major repairs or other inseparable improvement of housing, or refinancing of a loan issued for these purposes;
    • late payments on the loan last from 30 to 120 days inclusive from the date of application;
    • The mortgage loan was issued starting from 01/01/15.

The credit institution that issued the loan must be a participant in the program. Otherwise, obtaining support is impossible.

Requirements for mortgaged residential property

The following requirements apply to property secured by a mortgage agreement:

  • Mortgage housing is the only one for a citizen, while the person who has taken out a residential loan is allowed to own a common part of the ownership of another dwelling, but not more than 1/2 in any housing facility;
  • cost of 1 sq.m. Mortgage property should not be more than 50% higher than the similar price prevailing in the secondary or primary housing market, the calculation of which takes into account regional cost indicators and information from the statistical body at the time of concluding the loan agreement.

For borrower families with 3 or more children, requirements regarding the price and area of ​​mortgage housing are not applied.

For the possibility of applying state support to a borrower under the assistance program of JSC AHML within the framework of Resolution No. 373, the size of the debt on the mortgage loan, the currency of the loan and the facts of the borrower’s participation in previous restructurings are not important.

AHML borrower assistance program: package of documents for participation

The list of documents requires the borrower to confirm its compliance with the conditions of the 2017 state mortgage restructuring program with the help of AHML.

The final list is compiled by the financial institution and clarified by the borrower directly with the lending bank.

The validity period of the mortgage borrower assistance program was extended at the government level by decision of February 10, 2017 No. 127 until May 31, 2017 inclusive (further extension is possible). Reimbursement under the AHML mortgage loan borrower assistance program is provided for housing loans for which restructuring agreements were concluded before May 31, 2017.

You can receive monetary program support as mortgage assistance from the state AHML at the lending bank (its successor in the event of the first being deprived of its license or in the event of its bankruptcy) at the place where the restructured loan was concluded. Form and amount of support under the AHML assistance program

In accordance with the edition of Resolution 373 of 2017, the maximum amount of compensation for each loan for families with two or more children was increased to 30% of the balance of its amount as of the date of conclusion of the restructuring agreement, but not more than 1.5 million rubles.

The borrower independently chooses one of the forms of providing him with economic state assistance established by the government under the AHML assistance program:

  • writing off the loan amount in a single payment;
  • reducing the amount of the mandatory payment made every month on the loan for a period of up to 12 months in total for the entire period up to 200 thousand rubles;
  • forgiveness of part of the debt when the loan currency is changed to ruble;
  • transfer of a foreign currency loan into a ruble loan;
  • failure to make payments on the principal debt for a certain period with their postponement to a later date.

The maximum possible amount of support is a reduction of the loan amount by 10% of the outstanding debt.

Important! The volume of assistance provided per borrower cannot exceed 1.5 million rubles, and for a foreign currency mortgage loan - the rate is reduced to no more than 12% per annum for the period of validity of the loan agreement, for a ruble mortgage - to the rate the amount of which is applicable during restructuring.

An increase in the rate is possible only if the borrower significantly violates the terms of the loan.   • Replacing foreign currency mortgages with ruble ones. Moreover, the mortgage rate cannot be higher than 11.5% per annum. For a ruble mortgage, not higher than the current bank rate, except for cases provided for in the mortgage agreement, in case of violation of insurance rules.
  • Before September 1, a special interdepartmental commission must be created that will be able to increase the maximum payment under the program by 2 times and approve applications for participation if there are deviations from the basic conditions, but not more than in two points.

Who can receive support from the state

Government Decree No. 373, as amended on November 24, 2016, provides the following list of persons to whom the state can help pay mortgage payments:

  • Citizens of the Russian Federation with 1 or more minor children;
  • Guardians (trustees) of 1 or more minor children;
  • Participants in hostilities;
  • Disabled people or families with disabled children;
  • Citizens with dependent children under 24 years of age who are studying full-time at an educational institution.

Requirements for mortgage housing

To receive assistance from the state, the mortgaged apartment must meet these characteristics:

  • Should not exceed the total area for a one-room apartment - 45 sq.m., for an apartment with two rooms - 65 sq.m. and for three rubles or more - 85 sq.m.
  • Cost of 1 sq.m. the total area of ​​housing exceeds no more than 60% of the average cost of a typical apartment in your region on the date of conclusion of the loan agreement (according to the Federal State Statistics Service).

Requirements for mortgage borrowers

  • Russian citizenship

One extract on property rights throughout Russia is 1,500 rubles per person and no one will return it to you if you refuse. Last time there were a lot of complaints about this. As of August 11, 2017, the requirement to have an extract from the Unified State Register has been cancelled. The bank has no right to demand it. AHML independently requests it.

After a complete list of documents is provided to the bank, the responsible employee must send them to AHML for verification. On average, it lasts 30 days, but feedback from participants indicates that it can last up to six months. The bank and AHML request additional documents at their discretion.

When AHML makes a positive decision, the bank will notify you of the date of the meeting. Next, you will need to sign a new payment schedule, a new PSK document, enter into a restructuring agreement (additional agreement to the mortgage agreement), and an agreement to change the terms of the mortgage. The process is similar at Gazprombank. VTB 24 closes your mortgage and issues a new loan for a smaller amount, which means that you again have to pay for insurance and appraisal.

There is no charge for mortgage restructuring. Carrying out this procedure does not relieve you from paying the monthly payment and insurance premiums stipulated by the contract.

When the Housing Mortgage Lending Agency (AHML) announced at the end of May that state support for mortgage borrowers who had problems repaying their debt had ended, those who did not manage to fit into the program became worried. With the help of the program, which began operating on August 22, at least 1.3 thousand more mortgage borrowers will be able to restructure their debts. The state has allocated 2 billion rubles for these purposes, Managing Director of the Housing Mortgage Lending Agency (AHML) Alexey Nidens said at a press conference at the Rossiyskaya Gazeta media center.

Last time, by the way, 4.5 billion rubles were spent to support mortgage borrowers - that is, twice as much as is currently planned. And this is not the only difference between the new program. The previous one lasted two years, now the period is not specified - everything will end when the funds are exhausted. In addition, the state has adjusted the conditions for citizens to receive mortgage assistance.

Families with minor children and children under 24 years of age who are studying full-time at universities can become participants in the program. The state can also help disabled people, parents of disabled children and combat veterans - all those who belong to social categories and for whom assistance from the budget is truly justified.

In addition, all applicants for state support must meet a number of other criteria. In particular, the collateral apartment must be the only residence. Moreover, its size still matters. Thus, the area of ​​a “one-room apartment” should not exceed 45 square meters. That is, the state will not help restructure the mortgage received for an elite cottage. However, it is allowed to have a combined share of the borrower’s family members in the ownership of another residential premises (but only one!). To confirm rights to other housing, the borrower does not need to provide information from the Unified State Register of Real Estate. AHML will do all this for him.

In addition, assistance can be provided only if at least a year has passed from the moment of receiving a mortgage loan to the date of filing the application for restructuring, and the monthly loan payment has increased by at least 30 percent of the amount that the person paid to the bank when concluding the agreement. By the way, it was precisely because of the last point that the discussion managed to flare up: they say that state support has shifted towards foreign currency mortgages. After all, for “ruble” mortgage holders, the size of the payment does not vary so much, which means that such borrowers may not receive help for problem debts.

Alexey Nidens emphasized that mortgage holders who took out a loan in both foreign currency and rubles can apply for participation in the program. And if the size of the monthly payment on a foreign currency loan may increase due to exchange rate fluctuations, then in the case of a ruble mortgage we are talking about loans with a floating rate or when mortgage insurance is waived. In all other situations, the decision to provide assistance will be made by a special interdepartmental commission. It can positively resolve the issue of supporting citizens who do not even formally meet the conditions of the program, but are in dire need of help. The commission is expected to become operational in September.

The final decision to provide support is still made by the creditor bank. Because, as Niedens noted, the bank knows its borrower better, his financial situation at the time of signing the agreement, and can assess payment discipline.

Now AHML has signed agreements with hundreds of banks. However, financial ombudsman Pavel Medvedev also draws attention to some of the program’s rough edges. According to the new rules, the bank must agree to a rate of 11.5 percent (if the loan is issued in foreign currency). If the bank demands, say, 12.5 percent, the person will not receive support. AHML responds to this by saying that then the restructuring can be carried out on the terms of the bank’s own program.
